Fatwa number ( 20309 )
Q 1: A woman gave birth to a child who was six months old, and then he passed away. They shrouded him and placed him on the side of the farm under a sandy hill, and then a flood swept him away after two years. Is there any sin in that?
A 1: It is obligatory to bury the dead in solid ground far from flood channels in order to preserve their remains. What happened with the burial of this child in ground unsuitable for burial is considered an error, as you exposed him to being swept away by the flood. However, if you find any of his bones or remains, it is obligatory to wrap them in a cloth and bury them in the public cemetery. The one who does this must repent to Allah (Glorified and Exalted is He) for the aforementioned action.
