Q: A woman had severe disagreements with her husband, especially regarding financial matters, as her husband was lazy and did not strive to make her
family happy; this led her to buy electrical appliances on installment and sell them for cash to spend on her house, her children, and her husband as well. Her husband divorced her, and ten days after the divorce, after she had sold all the movable items in the apartment and her personal appliances, she set fire to herself and died. Is it permissible to make du'a, give charity, and perform Hajj on her behalf as expiation for the sin she committed? As for the debts she owed, who is responsible for paying them: is it the husband, or the one who pays her rights regarding her personal movable items (furniture and appliances) despite the debts she owed? Will the distribution be between the two children only, or also to her husband? Knowing that he refuses to pay the debts, and is this done after paying the debts from the value of these items? Please issue a ruling, may Allah reward you with good and forgive you.
A: A person killing himself is forbidden, and there is a severe warning for it, but this does not take him out of Islam; because it is a major sin among the major sins, not shirk. Therefore, he is a Muslim, and it is permissible to make du'a for him, give charity on his behalf, and perform Hajj on his behalf; because these are acts of devotion that benefit him if Allah accepts them. As for the debts mentioned on the woman who killed herself, they are paid from her estate by selling the items present after her death and paying the debts from their value. Her children have no inheritance until after the debts are paid. If any of the debts remain unpaid, it remains on the deceased, and it is not obligatory for the children or the husband to pay it except as a voluntary gift from them. They and other Muslims should seek reward and pay these
remaining debts. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
