The questioner : He says in his question: I am a married man and I support a family. I wanted to travel from my country to seek lawful earnings, but I could not afford the costs of travel procedures. My wife owned some gold jewelry, so she gave it to me to sell and benefit from its price for that purpose, and that was with her consent and choice. Before we traveled, my wife and I went to visit her family. When her father did not see the gold on her, he asked where it was, and she told him what had happened. He became angry with her and swore an oath, while her mother was sitting there, saying: "One of you is divorced tonight." When I learned of this, I said to my wife: "You are forbidden to me until I bring you your gold." Then I traveled here to Saudi Arabia and worked for eighteen months. Then I returned to my country on my leave and did not bring her the gold. I found her in my house and had relations with her. What is the ruling, first, on the father of my wife divorcing one of the two women sitting there, his wife and his daughter? What is the ruling on my forbidding her and having relations with her before I brought her the gold? And does the father of my wife have the right to object in such a matter, which is private between his daughter and her husband?

The Shaykh : The truth is that a person should control himself when angry, as the Prophet (peace and blessings be upon him) said:
The strong-man is not one who wrestles well but the strong man is one who controls himself when he is in a fit of rage. ليس الشديد بالصرعة إنما الشديد الذي يملك نفسه عند الغضب
Sahih Muslim 2609a
A man came to him and said: "O Messenger of Allah, advise me." He said:
Do not get angry لا تغضب
He repeated it several times, and he said:
Do not get angry لا تغضب
There is no doubt that the anger of your wife's father and your own anger is not appropriate. A person should have the strength to control himself when he is angry. And the statement of your wife's father, "One of you is divorced," does not divorce your wife, because he does not have the authority to divorce her.

The questioner : Yes.

The Shaykh : And your forbidding her until you bring her the gold is also a mistake on your part, and its ruling is the ruling of an oath, as Allah the Exalted said:
(1) O Prophet, why do you prohibit [yourself from] what Allah has made lawful for you, seeking the approval of your wives? And Allah is Forgiving and Merciful. (2) Allah has already ordained for you [Muslims] the dissolution of your oaths يا أيها النبي لم تحرم ما أحل الله لك تبتغي مرضاة أزواجك والله غفور رحيم قد فرض الله لكم تحلة أيمانكم
[At-Tahrim 66:1-2]
So Allah the Exalted made the forbidding an oath. Accordingly, it is obligatory for you to pay the expiation for an oath, since you made your wife lawful to you before bringing her the gold. The expiation for an oath is as Allah the Mighty and Majestic said:
the feeding of ten needy people from the average of that which you feed your [own] families or clothing them or the freeing of a slave إطعام عشرة مساكين أو كسوتهم أو تحرير رقبة
[Al-Ma'idah 5:89]
My advice to you is not to be hasty or angry. As for the fact that your wife's father is angry about your wife giving the gold, that is also not appropriate for him. He does not have the authority to place his daughter under a legal restriction as long as his daughter is sane, adult, and of sound mind, for he does not have the authority to restrict her. She is free to dispose of her wealth, especially since she gave it to her husband who traveled in order to obtain a livelihood for her and their children. Yes.

The questioner : May Allah reward you.
The next question is from listener A S A A from Yemen, Taiz Governorate.
