Q: May I ask the scholars of virtue to answer regarding the authenticity of the hadith narrated from 'A'ishah (may Allah be pleased with her), who said: The Prophet (peace and blessings be upon him) said:
The testimony of a treacherous man or woman, or one who bears a grudge, is not acceptedلا تقبل شهادة الخائن ولا الخائنة ولا ذي غِمْر
Sunan ad-Daraqutni 26:134
. The question is: the interpretation of the word "dhi ghimr." We have turned to you because of the saying of Allah the Exalted:
So ask the people of the message if you do not know.فَاسْأَلُوا أَهْلَ الذِّكْرِ إِنْ كُنْتُمْ لاَ تَعْلَمُونَ
[An-Nahl 16:43]

A: The mentioned hadith is narrated through several routes, among which is what 'A'ishah (may Allah be pleased with her) narrated from the Prophet (peace and blessings be upon him) in the wording:
The testimony of a treacherous man or woman, or one who bears a grudge, is not permissible regarding his brother, nor is it permissible for one suspected in kinship or allianceلا تجوز شهادة خائن ولا خائنة ولا ذي غمر على أخيه، ولا ظنين في قرابة ولا ولاء
Sunan al-Bayhaqi 18:327
It was recorded by al-Tirmidhi in (Jami', Vol. 2, p. 48), and al-Tirmidhi said: (It is not authentic
in my view due to its chain of narration). It was also recorded by al-Bayhaqi in (al-Sunan al-Kubra, Vol. 10, p. 155), and he said: This is weak. It was also recorded by al-Daraqutni (529), and he said: Weak, not to be used as evidence. This hadith was also transmitted from 'Amr ibn Shu'ayb from his father from his grandfather, traced to the Prophet, in the wording:
It is not permissible to accept the testimony of a man or a woman who does not fulfill their trusts, or of one who harbors a grudge against his brotherلا تجوز شهادة خائن ولا خائنة، ولا ذي غمر على أخيه

It was recorded by Imam Ahmad in (al-Musnad, Vol. 2, pp. 204, 225-226). It was also recorded by Abu Dawud in (his Sunan, No. 3600, 3601). It was also recorded by al-Bayhaqi in (al-Sunan al-Kubra, Vol. 10, p. 200). And by al-Daraqutni (528). Al-Hafith Ibn Hajar said in (al-Talkhis, Vol. 4, p. 198): Its chain is strong, and thus the hadith is authentic through this route and can be used as evidence. The meaning of the word
One who bears a grudgeذي غمر
mentioned in the hadith: It is stated in (al-Fath al-Rabbani, Vol. 5, p. 220): (And his saying:
Or one who bears a grudgeولا ذي غمر
with a kasrah on the ghayn, a sukun on the mim, followed by a rā': means: hatred and resentment. Al-Khattabi said: It is the one who has an apparent enmity with the person about whom he testifies). As for treachery in the hadith, it is not limited to betraying the trusts of people, but it is general for everyone who abandons something that Allah and His Messenger (peace and blessings be upon him) commanded His servants to do, or commits what Allah and His Messenger (peace and blessings be upon him) forbade; such a person is not just, and his testimony is not permissible; because of the saying of Allah the Exalted:
O you who have believed, do not betray Allah and the Messenger or betray your trusts while you know [the consequence].يَا أَيُّهَا الَّذِينَ آمَنُوا لاَ تَخُونُوا اللَّهَ وَالرَّسُولَ وَتَخُونُوا أَمَانَاتِكُمْ وَأَنْتُمْ تَعْلَمُونَ
[Al-Anfal 8:27]

And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
