Q: In our valley in Tihama, Qahthan, and Khawlan there is a custom called (the Hursiyyah) . It is that if one of them is killed and they do not know his killer, they guard him on the first night of his killing, before shrouding and burying him. Then men guard him, and he disappears and is far from people. During the guarding, the murdered man sits and says: “I am so-and-so, son of so-and-so, and my killer is so-and-so, son of so-and-so,” and by that the problem ends, and reconciliation takes place between the tribes. Is it true that the murdered man speaks, or is this from the works of Satan and the jinn? We ask for information to warn about this matter?
A: What was mentioned in the question has no basis in the pure Shari'ah; rather, it is
from the work of Satan, and it is not permissible for Muslims to act upon it. Killing is only established by the legal evidence, such as confession, righteous witnesses, and the oath of blood (al-lawth) with the oath of blood (al-qasamah). And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
