Q : There are customs among some tribes throughout the Kingdom, and since these customs differ from one another, in most of these
tribes there are customs that still exist to the present day, where if a killing incident occurs between these tribes for any reason, some tribes have problems among themselves for trivial reasons, and a killing occurs between them, they bury this person in his personal clothes that are on him without washing or shrouding, and they say: he is a martyr. Is that person a martyr? And is it permissible to bury him in this way?
A: One who is killed in defense of his religion, his blood, his wealth, or his honor is a martyr in terms of virtue and reward, but he does not have the ruling of a martyr of the battlefield; rather, he is washed, shrouded, and prayed over, as established in the Sunan of Abu Dawud from Sa'id ibn Zayd who said: I heard the Messenger of Allah (peace and blessings be upon him) say:Mishkat al-Masabih 3529 and al-Tirmidhi graded it as authentic. And 'Umar (may Allah be pleased with him) was killed wrongfully, and the Companions (may Allah be pleased with them) washed him and prayed over him, and likewise 'Uthman and 'Ali (may Allah be pleased with them both), they were killed wrongfully, and the Companions (may Allah be pleased with them) washed them and prayed over them. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
