Q2: What are the situations in which it is permissible to speak about one's Muslim brother in his absence without it being considered backbiting?
Vol. 2 : Backbiting is mentioning a Muslim brother in a way he would dislike, such as by his physical features, defects, or the like. However, there are instances mentioned by scholars in which a Muslim speaks about his brother based on public benefit. These instances include: seeking justice from an oppressor, where one says to a judge or ruler, for example, "So-and-so wronged me by such and such"; seeking a legal ruling, where the questioner says to the scholar, "So-and-so did such and such to me; is this his right or not?"; warning Muslims against people of evil and doubt, such as criticizing narrators and witnesses who have been found unreliable; consulting about marrying a person, partnering with them, or living near them; mentioning a person who openly commits open sinfulness regarding what he openly does; and identifying a person without the intention of belittling him, by using a nickname such as the One-Eyed, the Lame, the Deaf, or the like. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
