Q: I was born in France and I have been living there until now, where I am (26) years old. My parents are Tunisian, and I am currently married with two children, the first (4 years old) and the second (9 months old). I want to emigrate to an Arab country for the sake of my children’s future especially, and to preserve their religion and language. I intended to settle in Tunisia because all my family is there, and my parents intend to return there. But the problem is that the hijab is strictly forbidden for the Muslim woman there, even in the street, and all members of my family there were forced to remove the hijab. Also, it is not permissible there to have meetings or gatherings with a religious character, even if it is within a wedding party or otherwise. The Muslims there, especially the young ones, are forced to live alone and in constant fear, even just for the regular prayer in the mosque. Therefore, living there is impossible for me and my wife who wears
the hijab; because even for my children, I cannot guarantee that they will learn their religion there on correct foundations. And when I return to thinking about my current situation and how I am living in the land of the disbelievers, I find myself suspended between the earth and the sky, and I have no solution that comforts me; because I do not know whether emigration in this case is obligatory or not. I ask you to inform me, may Allah reward you with all good, with hadiths and Qur’anic verses on the basis of which I can make the correct decision, so that I do not regret it afterwards or feel that I have made a mistake.
A: We thank you, O brother, for this feeling and religious consciousness which is obligatory upon every Muslim who believes in Allah as Lord, in Islam as religion, and in Muhammad (peace and blessings be upon him) as Prophet and Messenger. We advise you to fear Allah the Exalted in all your affairs. We also inform you that residing in the lands of the disbelievers is forbidden in the Islamic Shari’ah except for a recognized need according to the Shari’ah, such as a treatment not available among Muslims, or calling to Islam, and the like. You must strive and exert the means that will free you from remaining in the lands of the disbelievers and move to the lands of the Muslims, even if it is not your home country where you were born. And Allah the Exalted says:[At-Talaq 65:2-3] , and if your situation in France and Tunisia is as you mentioned and emigration is not facilitated for you,
then you must fear Allah in yourself, hold fast to your religion and be steadfast upon it, and preserve the rituals of the religion such as the five daily prayers and others. You must constantly seek refuge in Allah that He may firm your heart. You must stay away from the company of people of evil and sitting with them. If you find any of the Muslims, stick to their company. Also, you must call to Allah according to your ability. We ask Allah the Generous to grant you success and to facilitate good for you wherever you are, for He is the One who has that in His power and is capable of it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
