Cutting the head of a chicken during its slaughter

Q 3: Some people accidentally cut off the head of a chicken during its slaughter because the dagger was sharp. The chicken had flapped about and blood had flowed from it. Is this slaughter permissible, or is it forbidden? And consequently, does its owner have to throw it away?
A 3: If this person struck with the dagger and cut off the chicken's neck without intending to slaughter it, then it is carrion and not permissible to eat; because it is a condition of slaughter to mention the name of Allah at the time of slaughtering and to intend the slaughter, and in this case he did not mention the name and did not intend the slaughter. Allah the Exalted said:
And do not eat of that upon which the name of Allah has not been mentionedوَلاَ تَأْكُلُوا مِمَّا لَمْ يُذْكَرِ اسْمُ اللَّهِ عَلَيْهِ
[Al-An'am 6:121]
And it is authentic from the Prophet (peace and blessings be upon him) that he said:
Actions are only by intentionsإنما الأعمال بالنيات
. However, if this person, when passing the dagger over the chicken's neck, intended to slaughter it and mentioned the name of Allah upon it, and slaughtered it from the side of the throat and the windpipe, cutting the windpipe and the esophagus and the jugular veins, then it is a slaughtered animal and its meat is permissible to eat; because the conditions of slaughter are present in it. And if the slaughter was from the back of the neck, then if he cut the windpipe and the esophagus, and the animal had a stable life due to the sharpness of the tool and the speed of the cut, then it is sufficient, and its meat is permissible to eat if he intended to slaughter it and mentioned the name of Allah at that time. And if he left off the mention of the name out of forgetfulness, there is no blame on him.
It is permissible to eat from it, and he is excused for leaving off the mention of the name due to his forgetfulness. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
