Making divorce conditional on a condition while not intending divorce
Machine translationRead the Arabic original
Fatwa number ( 4587 )
Q: This happened to me on Sunday night, before Maghrib, on the eve of Monday. When I told my wife to turn off the television, she refused to turn it off. I told her several times, but she refused. I said to her, “If you do not turn it off, you are divorced,” but she did not turn it off. I did not intend divorce by that, but rather I was threatening and warning her so that she would turn it off. I bear witness to Allah, and then I bear witness to you, that my wife is under my protection, and that I have taken her back. And Allah is the best witness to what I say.
A: If the situation is as you described, you are only required to pay the expiation for an oath, which is: freeing a believing slave, or feeding ten poor people from the middle of what
you feed your family. It suffices for you to give ten poor people five sa' (a dry measure of about 3 kg) of wheat, dates, rice, or corn, or something similar to what you feed your family, with each of them receiving half a sa'. If you wish, you may clothe ten poor people, giving each of them a garment that covers them. If you are unable to feed or clothe them, then fast for three days, and it is better if they are consecutive. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
