Q: I committed the secret habit in the month of Ramadan, then I fasted that day. I told my wife: I want to have intercourse with you in the tent, not during the daytime of Ramadan. So I swore that I would not have intercourse with her, then I did have intercourse with her in the tent outside the city. I also swore that I would not commit a forbidden act, then I intended to commit a sin, but Allah saved me and I did not do it. I also took two thousand from my father, intending to return it to him, but I did not return it. Then my father passed away, and the money is still with me, knowing that there are
heirs. Please rule on all of the above, may Allah reward you.

A: It is obligatory for you to make up the day on which you committed the secret habit, along with repentance to Allah the Exalted for that; because the secret habit is forbidden and it invalidates the fast, so do not return to such an act, neither in Ramadan nor in any other time. It is obligatory for your wife to pay the expiation for the oath she swore to prevent you from having intercourse with her, but you violated it. The expiation is: feeding ten poor people, giving each poor person one and a half kilograms of food, or clothing them, or freeing a believing slave. If you cannot find the means to do so, you fast for three days. There is no expiation for you regarding what you swore to leave, then you intended to do it but did not do it; because mere intention does not obligate an expiation. As for the amount you took from your deceased father, it is obligatory for you to return it to his heirs; because it is their right. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
