Q: The saying of some Muslims: “By the Prophet” , “By your life,” “By the most noble people,” or swearing with Allah—may Allah protect us from that—is ignorance of the severity of such a matter, or are traditions and customs the cause of the spread of this phenomenon? Are there other causes? What is the role of the media in raising awareness about this phenomenon? And what is the role of Muslim preachers in
raising awareness about this phenomenon?
A : It is not permissible to swear except by Allah the Exalted or by one of His attributes; because swearing by other than Allah is shirk (associating partners with Allah); due to the saying of the Prophet (peace and blessings be upon him):Sunan Abi Dawud 3251Sahih (Al-Albani) , and his saying (peace and blessings be upon him): Sahih al-Bukhari 2679 ; because swearing is an act of exalting the thing by which one swears, and exalting in this manner is a right belonging to Allah the Exalted, so it is not permissible to swear by other than Him. Whether one swears by the Prophet or by any other creation, all of this is not permissible. Likewise, swearing by something from the creations along with Allah (Glorified and Exalted is He), such as saying: “By Allah and the Prophet, I did not do such-and-such, or I did such-and-such.” It is obligatory for scholars in general, and for preachers to Allah in particular, to warn against this and to clarify the truth for people; so that they may be upon clear understanding of their affair. They should warn them against the customs of the pre-Islamic age of ignorance and imitating fathers and ancestors without guidance. Likewise, it is obligatory for the media to alert people and warn them against falling into these customs of the pre-Islamic age of ignorance, by publishing what is issued by scholars regarding the clarification of creed and matters of religion, and warning against shirk (associating partners with Allah) and violations. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
