Q1: Paying a bribe in order to obtain your right. For example, a person did some work for one of the organizations, and when he tried to obtain the money due to him, he encountered the stubbornness of the employees and hints that these funds would not be paid unless he paid them a bribe. This person, for instance, has no other way to obtain the money due to him except through the courts, knowing that the lawyer’s fees amount to several times this sum until the case is decided in favor of one of the parties. Is it permissible to pay the bribe or not?
A1: Taking a bribe and paying it to the bribe-taker, and conveying it from the briber to the bribe-taker, is among the major sins. This is based on what was narrated by Ahmad , Abu Dawud , al-Tirmidhi , and Ibn Majah from 'Abdullah ibn 'Amr , that the Messenger of Allah (peace and blessings be upon him) said:Sunan Ibn Majah 2313Hasan (Darussalam). And based on what was narrated by Ahmad , al-Tirmidhi , and al-Hakim from Abu Hurayrah (may Allah be pleased with him), that the Messenger of Allah (peace and blessings be upon him) said: Sahih Ibn Hibban 30:22. And based on what was narrated by Ahmad from Thawban (may Allah be pleased with him), that the Prophet (peace and blessings be upon him) said: Al-Mustadrak lil-Hakim 30:66. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
