The questioner :Sunan Abi Dawud 3580Sahih (Al-Albani) So what do you advise these people who take bribes from people? And if they pray, do their prayers, zakah, and fasting benefit them? I hope you will give us advice and guidance on this.
The Shaykh : Bribery is a type of illicit gain, which is: taking money for what one is obligated to provide for free to the bribe-taker. It occurs in the judiciary, in governance, in the ministry, in administration, and in every job. Any person who takes money for what is his duty is a bribe-taker.
And consuming illicit gain is similar to the Jews, for they are the listeners of falsehood and the consumers of illicit gain. It was narrated from the Prophet (peace and blessings be upon him) that: And it is obligatory for the Muslim community to stand for Allah the Exalted with justice and not to favor the one who gave them a bribe.
We have two considerations here. The first consideration: the bribe-taker, i.e., the one who takes the bribe. It is forbidden for him to take a bribe in all cases.
The second consideration: the bribe-giver, i.e., the one who offers the bribe. If he offers the bribe to reach a falsehood or to encroach upon someone who is more deserving of what he is seeking, then he falls under the curse and it is forbidden for him to do so. Yes. And if he offers this bribe to reach his right in which he is being wronged, then there is no blame on him in this, and the sin is on the bribe-taker, who is the one who takes the bribe. And if bribery enters into the affairs of the community, in the interests of the nation, then the community is corrupted, its order is disrupted, and it leads to destruction and ruin.
