Q: We ask your Eminence to issue a ruling on the following statements made in an interview with the magazine (Mir'at al-Ummah) with Dr. Shamlan al-Isa , Professor of Political Science at Kuwait University : "The Islamic system has left nothing but corruption in the Islamic state." And in response to the magazine's question: "What is your opinion on applying the Islamic Shari'ah in Kuwait ?" he answered: "I am against applying the Islamic Shari'ah in Kuwait." We ask for an answer to this statement made in the interview, and we thank you greatly.
A: Whoever says: "The Islamic system has left nothing but corruption in the Islamic state, and that he is against applying the Islamic Shari'ah," or similar expressions that disparage the Islamic Shari'ah, or disparage some of the rulings of
the Shari'ah — then he becomes an apostate from the religion of Islam. It is obligatory to call him to repent, and if he repents, well and good; otherwise, he is to be killed. This is based on the saying of the Prophet (peace and blessings be upon him):, and his saying (peace and blessings be upon him): Sunan an-Nasa'i 4721Sahih (Darussalam). Insulting the religion and disparaging the Islamic Shari'ah is abandoning the religion and changing it. Allah the Exalted said: [At-Tawbah 9:65-66]. The judgment on the one who says such words is referred to the Shari'ah court. However, if the speaker is criticizing the poor application of the Shari'ah, this is not apostasy, but he must clarify the point of his criticism and not attribute it to the Shari'ah. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

من بدل في دينه فاقتلوهIt is not permissible to shed the blood of a Muslim except in one of three cases: A soul for a soul, a adulterer who has been married, and one who separates leaving his religion.
لا يحل دم امرئ مسلم إلا بإحدى ثلاث: النفس بالنفس، والثيب الزاني، والتارك لدينه المفارق للجماعة(65) And if you ask them, they will surely say, "We were only conversing and playing." Say, "Is it Allah and His verses and His Messenger that you were mocking?" (66) Make no excuse; you have disbelieved after your belief. If We pardon one faction of you - We will punish another faction because they were criminals.
قُلْ أَبِاللَّهِ وَآيَاتِهِ وَرَسُولِهِ كُنْتُمْ تَسْتَهْزِئُونَ (65) لاَ تَعْتَذِرُوا قَدْ كَفَرْتُمْ بَعْدَ إِيمَانِكُمْ
