Q 1: IndeedI have a cousin who works in traffic, and I know that he takes bribes from drivers, and he says: it is war spoils. Is it war spoils?And what are war spoils nowadays? And after that,he sent me a gift while he is in the state of taking bribes. Should I accept it from him?And what should I say to him after that? And what do you advise him? And should I sit with him? But when he comes to us, he prays the prayer at its times, and when I sit with him, I find from him a breath of faith. What is the ruling regarding him?
A 1: If the gift he sends you is from the bribe he takes, it is not permissible for you to accept it. If you do not know whether it is from the bribe or something else, or you know that it is from something else, there is no harm in taking it. But if most of his wealth is from bribes, do not accept it, acting out of caution. And if returning his gift is closer to reforming him, guiding him, and making him aware of the badness of his work, it should be returned absolutely. As for calling it war spoils, it is a lie, and naming the forbidden
with a name other than its own so that he may consider it lawful thereby. He should be advised, perhaps Allah will guide him. Our advice to your cousin is to fear Allah, to account for himself, and to beware of taking bribes from drivers, because it is injustice, aggression, and betrayal, and it is not war spoils. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
