Q 11: What is the ruling on the slaughter of an apostate with the mention of Allah's name at the time of slaughter , and is it prohibited to eat it?
A 11: The slaughter of an apostate is not lawful to eat, and this is the position of the Hanbalis , and it is the statement of Malik and al-Shafi'i and the Hanafis ; because he does not affirm his religion, so his slaughter is not lawful, like that of a polytheist, and because the rulings of the People of the Book are not established for him if he adopts their religion, for he does not affirm the jizyah, is not enslaved, and a Muslim does not marry an apostate woman, rather he must be killed; due to the generality of the saying of the Prophet (peace and blessings be upon him):
Whoever changes his religion, execute him.من بدل دينه فاقتلوه
Sunan Ibn Majah 2535Sahih (Darussalam)
, so the command to kill him indicates that he has no sanctity at all, and thus his slaughter is not lawful. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
