Q: What is the ruling on utilizing the meat and hides of the ostrich ?
A: The default ruling for foods is that they are lawful; as Allah the Exalted said:
O mankind, eat from whatever is on earth [that is] lawful and goodيَا أَيُّهَا النَّاسُ كُلُوا مِمَّا فِي الأَرْضِ حَلاَلاً طَيِّبًا
[Al-Baqarah 2:168]
and He said:
Say, "Lawful for you are [all] good foodsقُلْ أُحِلَّ لَكُمُ الطَّيِّبَاتُ
[Al-Ma'idah 5:4]
Nothing departs from this default ruling except what has been prohibited from being eaten, such as impure things like carrion, blood, and the flesh of swine, and what contains harm, such as poison and the like, and every predator with fangs among wild beasts—except the marmot—and every raptor with talons among birds, domestic donkeys, and animals that eat carrion. As for the ostrich, it is permissible to eat it because it falls under this default ruling, and because the Companions (may Allah be pleased with them) ruled on it with a ransom payment; and because it is a food that is enjoyed, and it does not have fangs. If that is permissible, then it is also permissible to utilize its hide. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
