Q: There are some institutions, and this institution provides housing for those who wish to reside there from among its members. For those who do not wish to reside there, the institution pays them a housing allowance (in money). However, some of those who take the housing allowance visit the institution's housing and stay there for a month or two, and they are negligent in this matter. What is the ruling on the money they receive due to this action? Does this allowance mix with other income that comes to them from other sources? And is it permissible for others who know of their actions to enter their hospitality and eat from that hospitality? I am in difficulty regarding this matter and in confusion. What is my duty toward this? The matter is not easy, and our Messenger (peace and blessings be upon him) says:
Leave that which makes you doubt for that which does not make you doubt.دع ما يريبك إلى ما لا يريبك
Sunan an-Nasa'i 5711Sahih (Darussalam)

And he (peace be upon him) says:
None of you will have faith till he wishes for his (Muslim) brother what he likes for himself.لا يؤمن أحدكم حتى يحب لأخيه ما يحب لنفسه
Sahih al-Bukhari 13

A: First: If the situation is as described, it is not permissible for one who is given the choice by the institution's employees between housing and the allowance to combine both, by residing there and taking the allowance. Rather, it is obligatory for him to return the allowance to the institution if he resides in its housing. Second: If he mixes what he took as a housing allowance with his lawful money, it is permissible for others to eat from it according to the correct opinion of the scholars. And if he has no money other than this allowance, it is not permissible to benefit from it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
