The second question of Fatwa No. ( 9850 )
Q 2: A person committed zina and died, and the hudud punishment was not carried out on him. What is his ruling? Some scholars said: He will be punished on the Day of Resurrection. It was also said: The one who applies the hudud for zina must be one who is protected from committing zina himself beforehand. What is the ruling on that?
A 2: If one commits zina and the hudud is carried out on him, it is an expiation for him. If he dies, his case is left to Allah. As for the one who applies the hudud, it is the Shari'ah judge. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
