Q3: In the year 1397 AH, I was going hunting with a rifle,
and when I returned home, I found my sons and daughters, and my brother’s sons and daughters, welcoming me. The eldest among them was my brother’s daughter, so I gave the rifle to my brother’s daughter, and there was a bullet in it. I was preoccupied with talking to a visitor who came to see me that day, and my brother’s daughter placed the rifle on the head of my small daughter and fired the bullet from the rifle, which resulted in my daughter’s death. My question is: Does fasting or a ransom payment become obligatory upon me for this to clear my conscience? Please guide us, may Allah reward you with the best reward.
A3: If the girl to whom you gave the rifle had reached puberty at the time she fired it, by completing fifteen years of age, or by menstruation, or by the growth of pubic hair, or by the emission of semen due to desire or a wet dream, then the expiation is upon her, which is freeing a believing slave. If she does not find one, she must fast for two consecutive months, sixty days. However, if she had not reached puberty, the expiation is upon you, because you were negligent in handing her the rifle with the bullet in it. As for the blood money, the reference for it is the court if you are claiming the blood money. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
