Fatwa number ( 20774 )
Q: My mother is old and advanced in age, and she listens to many fatwas from the shaykhs (may Allah preserve them) via the radio. She mentioned that she was in the post-natal period after giving birth to a son, and during her illness she was nursing him. Due to the severity of her illness, she covered the boy while she was under the same blanket. When she recovered and wanted to nurse her child, she found that he had died. Is she required to pay an expiation for this or not? May Allah reward you with the best reward.
A: If she placed the blanket over his face and he died as a result, then she is required to pay an expiation, which is freeing a believing slave. If she cannot find one, then she must fast for two consecutive months (sixty days). If she did not place the blanket over his face, then she owes nothing, because she was not the cause of his death.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
