Fatwa number ( 21357 )
Q: A woman gave birth to a child, and his legs came out before his head. She cut the umbilical cord but did not tie it, meaning she did not bind his navel, while his head was still in the womb. When the child came out, he was alive, but he died moments later. She is now asking: Does she owe an expiation? Knowing that more than forty years have passed since this incident, what should she do? She is advanced in age and is unable to perform the expiation. May Allah reward you with good.
A : If the child’s death occurred due to the aforementioned act, which is cutting the umbilical cord and not tying it, then the person who did so owes the expiation for killing, which is freeing a slave. If she does not find one, then she must fast two consecutive months. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
