Q: A woman was sleeping in her bed with her young daughter beside her. During the sleep, her older sister came and positioned herself between the mother and the young sister. Then the young girl moved to the foot of the bed, and the blanket was heavy in the cold days. This young girl then passed away. Her mother is now over seventy years old and is unable to fast. She was previously unaware of this matter and asks: What is required of her?
A: If the situation is as described, where this girl moved to the foot of the bed and went under the heavy blanket by herself until it smothered her, and the mother did not cover her with this blanket, then there is no sin upon her and no expiation for the death of this young girl due to this blanket; because her causing of her death is not established. The original state is that the conscience is clear until the contrary is proven.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
