Q: I married a woman and she bore me three children. When she gave birth to the third child and weaned him, I asked her not to become pregnant, and I said to her: If you become pregnant, you are divorced. These days, it has become clear to me that she is pregnant, but I had been having intercourse with her while taking precautions to ensure she would not become pregnant. I ask Allah, then you, to answer my question. May Allah guide you and keep your steps on the path of good. He is the All-Hearing, the Responsive.
A: You were wrong to prevent your wife from becoming pregnant, and you have broken your oath by making the divorce conditional on pregnancy, so the divorce takes effect. You may take her back before she gives birth, provided this divorce is not the third of three divorces. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
