Q: What is the ruling on a wife asking her husband for a divorce without any of the reasons that would cause her distress; because she came after a second wife, and it was not that he came to her after her? Knowing that she is in a separate apartment and no one is causing her distress, and she is currently five months pregnant, is divorce permissible? And is she obligated to bear the expenses as long as she is the one requesting the divorce?
A: Divorce of a pregnant woman is permissible, and as for a woman requesting divorce without a reason, the prohibition of it has been reported. In the hadith of Thawban (may Allah be pleased with him), the Messenger of Allah (peace and blessings be upon him) said:Musannaf Ibn Abi Shaybah 8:1348 It was narrated by Abu Dawud and al-Tirmidhi As for financial maintenance, the reference is the court if they do not reach an agreement.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
