Fatwa No. ( 263 )
Q: A man received forged letters concerning his family, and he believed them to be true, so he divorced his wife on that account, and then it became clear to him that they were forged afterwards. He asks whether his divorce takes effect given the circumstances described?
A: If the matter is as described, such that the divorcer did not divorce his wife except based on these letters which he believed to be true, and then it became clear to him that they were forged and false – then his divorce, given the circumstances described, does not take effect; because
the divorce mentioned, in the manner described, is considered of the type of divorce contingent on a condition that did not occur. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
