Q: A man married a French woman without a Shari'ah contract, and she bore him children. After that, he repented to Allah and wanted to renew his marriage to the same woman with a Shari'ah contract. Are his previous children considered children of fornication? Is it permissible for them to remain with him in this case? Is it permissible to tell them frankly that they are not legitimate children? Please give us a ruling, may Allah reward you.
A: The children born before your Shari'ah contract with the woman are considered children of fornication. If you inform the children of the reality, there is nothing wrong with that. As for their remaining with you, providing for them, and being kind to them to the best of your ability, this is a good thing after both of you have repented to Allah. If you wish to marry, it is permissible to proceed with it once its pillars and conditions are met and its impediments are removed. They bear no sin for what happened.
