Fatwa No. ( 3554 )
Q: A dispute arose between me and my wife, and I said while I had lost my temper and my senses: (You are forbidden to me just as my mother is forbidden to me, and my body shall not touch your body as long as I am alive)
A: If you intended by this statement divorce, then one divorce takes effect from you regarding her, and you may take her back as long as she is in the waiting period, provided that two divorces did not precede this one and you did not follow it up with another. If you did not intend divorce by it, then you must pay the expiation for likening one's wife to a forbidden relative, which is: freeing a believing slave. If you do not find one, then fasting two consecutive months. If you are unable to do that, then feeding sixty poor people, with each poor person receiving half a sa' (a dry measure of about 3 kg) of wheat, rice, or the like of what is usually eaten, and no divorce takes effect from you in this case.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
