Q: A man traveled from one town to another, leaving his wife in his home with his father and mother. During his absence, he received news that his wife had left his home and returned to her parents’ home. When the news reached him, he said: “I have made her forbidden
to me as my mother is forbidden to me,”
and then it became clear to him afterward that the news he had received was true. What is the ruling?

A: If the matter is as you described, where you said: “I have made her forbidden to me as my mother is forbidden to me,” based on the news you received about her leaving your home, and then it was confirmed that the news was true—then what occurred on your part is zihar, which is forbidden, and you must repent from it; because Allah the Exalted said:
Those who pronounce thihar among you [to separate] from their wives - they are not [consequently] their mothers. Their mothers are none but those who gave birth to them. And indeed, they are saying an objectionable statement and a falsehoodالَّذِينَ يُظَاهِرُونَ مِنْكُمْ مِنْ نِسَائِهِمْ مَا هُنَّ أُمَّهَاتِهِمْ إِنْ أُمَّهَاتُهُمْ إِلا اللائِي وَلَدْنَهُمْ وَإِنَّهُمْ لَيَقُولُونَ مُنْكَرًا مِنَ الْقَوْلِ وَزُورًا
[Al-Mujadila 58:2]
And if you wish to return to your wife, you must fast for two consecutive months before you have any intimacy with your wife, provided you do not find a slave to free. If you are unable to fast, you must feed sixty poor people before having any intimacy with your wife. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
