Q: I am the eldest of my siblings and the poorest among them. We purchased land in Khumais Mish'at, and they wanted to develop it, but I cannot afford to pay my share of the construction costs. So they wanted to exclude me by giving me a public housing unit that my father built while he was still alive. My father was very angry; how could they divide his wealth while he is still alive? So I broke the contract and said: “I prohibit it from myself just as I prohibit my mother from myself.” After a period, my father reconsidered, and my siblings forced me to accept this house on the pretext of making it for my children. I did not accept it in my heart without a fatwa. I ask you to look into my case.
A: If your father has permitted this house for you, and your other brothers and sisters (if you have sisters) have also permitted it, there is no harm in accepting it. You must expiate the prohibition that came from you with the expiation for an oath, which is: feeding ten
poor people, with each poor person receiving half a sa' (a dry measure of about 3 kg) of the local food. The total amount of the expiation is fifteen kilograms of food, with each poor person receiving one and a half kilograms. Alternatively, you may clothe ten poor people, with each poor person receiving a garment, or free a slave, at your choice. If you cannot find any of these, then fast for three days.
