The ninth question of Fatwa number ( 9881 )
Q9: A man contracted his marriage to a woman, and before consummation, as a result of a dispute, he said to her: You are divorced, and he left. Then he returned after a week and said to her: I did not intend a divorce, and he traveled to work outside the country and asked her to travel to him for consummation. Does the divorce take effect with this statement? And if it is valid, and the woman has no waiting period to observe before intercourse with her, is a new contract obligatory for him, or is it sufficient that he took her back in his mind? And may Allah reward you with good.
A9: If the situation is as described, his wife is considered divorced by a final divorce, and she has no waiting period; because of the saying of Allah the Exalted:
O You who have believed, when you marry believing women and then divorce them before you have touched them, then there is not for you any waiting period to count concerning themيَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا نَكَحْتُمُ الْمُؤْمِنَاتِ ثُمَّ طَلَّقْتُمُوهُنَّ مِنْ قَبْلِ أَنْ تَمَسُّوهُنَّ فَمَا لَكُمْ عَلَيْهِنَّ مِنْ عِدَّةٍ تَعْتَدُّونَهَا
[Al-Ahzab 33:49]
the verse. She does not become lawful to him except with a new contract and a new mahr with her consent. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
