Q: I said to my wife while I was angry: "Cover yourself from me," and I did not intend divorce. So, is she divorced or not? Knowing that I have never divorced or granted a khul' before, and that 8 days have passed, and that my wife was in post-natal bleeding at the time of the utterance.
A: If the matter is as you described, that you said to your wife: “Cover yourself from me” while angry, but you did not intend divorce by your words, then your wife is not divorced; because the criterion in such cases is the intention and purpose. The Prophet (peace and blessings be upon him) said:
The reward of deeds depends upon the intentions and every person will get the reward according to what he has intended.إنما الأعمال بالنيات، وإنما لكل امرئ ما نوى
Sahih al-Bukhari 1
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
