Fatwa No. ( 294 )
Q: A dispute arose between me and my wife and her family, and she is with them. I have children from her. I became angry and, without realizing it afterward, I divorced her with one pronouncement of divorce. I took her back in the afternoon on that same day and witnessed the taking back with (N.S.R) and his brother (M.S) and (M.M.F). There was no prior divorce, nor any subsequent one, and there was no compensation. She is still in the waiting period. Is she lawful to me?

A: You mentioned in your question that the divorce occurred from you while you were not aware. If you have just evidence that testifies to what you are saying, then this divorce does not take effect. If you do not have evidence, then this is one revocable pronouncement of divorce, and your taking her back is valid. The continued status of your wife under your protection does not require a new contract or her consent. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
