Q3: Why does Islam place divorce in the hands of the husband alone, and what is the ruling if the husband himself is unbearable to live with, and how is it said that Islam has made things equal between the woman and the man?

A3: First: Allah placed divorce in the hands of the husband alone for great wisdoms, among which are: 1- The strength of his intellect and will, the breadth of his understanding, and his foresight regarding the consequences of matters, unlike the woman, who is not so. 2- His responsibility for financial maintenance and his role as the one in control and authority in his home, for he is the pillar of the home and the head of his family. 3- The fact that the mahr is obligatory upon the husband, so divorce was placed in his hands so that the woman would not be greedy; if she married and took the mahr, she would divorce her husband to obtain another mahr, and so on, which harms the husband. Allah the Exalted drew attention to this meaning in His saying:
Men are in charge of women by [right of] what Allah has given one over the other and what they spend [for maintenance] from their wealth.الرِّجَالُ قَوَّامُونَ عَلَى النِّسَاءِ بِمَا فَضَّلَ اللَّهُ بَعْضَهُمْ عَلَى بَعْضٍ وَبِمَا أَنْفَقُوا مِنْ أَمْوَالِهِمْ
[An-Nisa 4:34]
Second: If the husband himself is unbearable to live with, the matter is referred to the court. Third: Allah established rulings specific to the man, established rulings specific to the woman, and made them share in many rulings, and the reference for this is the Shari'ah.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
