Praise be to Allah alone, and peace and blessings be upon the one after whom there is no prophet,
After that: The Permanent Committee for Scholarly Research and Ifta has reviewed what was sent to His Eminence the Grand Mufti from the honorable judge of al-Harjah , No. (504), dated 6/4/1412 AH, and its accompanying inquiry (J. A. A.), which reads: A car accident happened to me, and the result of the accident was that my son , who was 13 years old, died. I am presenting to you how the accident occurred, hoping that Allah the Mighty and Majestic will grant you the ability to issue a fatwa regarding this, and whether I am required to fast two consecutive months or not? May Allah reward you with good. On the afternoon of Tuesday, 27 Shawwal, while I was returning from the town of Dhahrān al-Janūb to the Emirate of al-Harjah , where I reside, and on the way, my speed was about (90 km) per hour, the car started going left and right, and I did not know the reason for that, and I could not control it due to its swaying left and right. At the same time, I felt as if a veil had covered my vision, and in a few moments, the car veered off and fell from a bridge I was near, and it overturned twice, coming to rest at the bottom of the bridge. The result was that my son died, a vertebra in my back was broken, and the leg of another of my sons was broken, and then two vertebrae in my wife's back were broken. After I left the
hospital, no responsibility was established against me from the traffic department or from the judge at all, and I did not ask anyone, near or far, about anything. Therefore, I came hoping that you would be kind enough to inform me about that, and may Allah reward you a thousand times with good? The case was returned to the honorable judge for inquiry and further clarification, and his response came back with No. (1357), dated 19/3/1413 AH, and was referred to the Committee by the General Secretariat of the Council of Senior Scholars with No. (1357), dated 19/3/1413 AH, and it read as follows: We inform Your Eminity that upon reviewing the aforementioned matter with him and explaining the content of your letter to him, he answered by saying: Regarding the cause of the accident, he felt while driving that the steering wheel was loose, and at that point the car started swaying left and right. As for why he did not stop, it is because when he took hold of the steering wheel and tried to stop it, he was unable to do so. He tried to stop it using the handbrake to avoid pressing the brake pedal, fearing a rollover, but he was surprised by it overturning. He does not have a copy of the traffic report for the accident. Regarding the driving license, he has one, and a copy of it is attached to our letter.

A: After the Committee studied the inquiry, it answered that if the facts are as stated, then he owes nothing; because he did not neglect his duty, and the original presumption is the innocence of the conscience.
