Q: An accident occurred to me, and the owner of the car that collided with mine passed away. The error was mine, as determined by the traffic department, because the owner of the car in which the driver died was driving on the coastal road, a public road, at a slow speed, and I hit him from behind, resulting in his death. I was with
my family, and my son passed away with me (may Allah have mercy on him). The judge ruled that I must free a slave or fast for two months, while the judge did not address my son and did not rule anything regarding him. I have inquired from several scholars; some say: you owe four months, and some say: two months. Since I am confused, I ask your eminence to issue a fatwa on my matter.
A: If the situation is as you described, it is obligatory for you to perform another expiation for your son who passed away with you, because you were the cause of his death in this accident. The expiation is freeing a believing slave; if you cannot find one, you must fast for two consecutive months. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
