Q: We seek your legal ruling regarding two men from the group, one of whom has passed away and the other is still alive. They committed a crime in the year 1385 AH. They were in the city of Riyadh on the 29th of Shawwal, driving in their car. They did not hit anything but a man in the middle of the street suddenly,
and they were unable to take control, so the car struck him while they continued walking, and after that the driver stopped and his brother said to him: "Go," and they overcame their fear and left. The driver fasted for two months, and the one who is present is ready to do whatever is obligatory upon him and his brother. Please inform us, may Allah reward you with good.

A: If the facts are as stated, the driver is obligated to pay the blood money for accidental killing to the heirs of the one who was run over, unless they forgive him. It is obligatory for him, or for his guardian if he has died, to identify them through the police who investigated the matter, and to seek their forgiveness for the rights he has neglected toward them. The living one of the two must repent to Allah for concealing the crime, with a sincere repentance that includes paying the rights to their owners or seeking their forgiveness, as previously mentioned. May Allah accept their repentance, for He is the All-Hearing, the Responsive. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
