Fatwa number ( 15436 )
Q: I was driving my car to the mosque for the 'Isha' prayer. My speed did not exceed 35 kilometers per hour. A woman was exercising on the opposite sidewalk. Suddenly, she tried to cross the road to the other sidewalk without checking if the street was clear of cars. She surprised me because I had expected her to be on the other sidewalk. I hit her with my car despite all my attempts to avoid the collision, and she died on the spot. There was no pedestrian crossing at that location. When the police arrived and investigated the causes of the accident, they found that the error was on the woman's part, not the driver's. After a long investigation, they released me. As I inform you, I am a Muslim man, married with six children, working in France. The woman involved in the accident is a French Christian. It is known that all French people benefit from life insurance, meaning that everyone who is
an accident receives compensation for all losses resulting from that accident. In the case of death due to an accident, the insurance company gives a sum of money to the victim's family. My question to you is: Is it obligatory for me to fast two consecutive months and pay blood money to the woman's family? And what is the ruling of the Shari'ah in this case? Please give us a ruling, may Allah reward you with good. This accident has distressed me, for since it happened, I have not tasted the comfort of sleep or food. I want a quick answer from you. May Allah reward you with good.

A: If the situation is as you described, then you owe nothing, because she was the one who caused her own death. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
