Q1: A woman proposed her daughter to a man about five months ago, but no marriage contract was concluded and he did not consummate the marriage until something occurred between them. The man then broke off the proposal, and the daughter’s mother wants to marry this man. What is the ruling?
A1: If the situation is as described, where the man proposed to the girl and did not
conclude a marriage contract with her, and then broke off the proposal, he may marry her mother. This is because the prohibition of his marrying her is only established by his contracting marriage with her daughter. As Allah the Exalted said:[An-Nisa 4:23] up to His saying: This girl did not become one of his wives merely by the proposal. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
