Q1: My eldest brother passed away, leaving behind his wife and a child who was less than one year old. I wish to marry his widow after my brother's death, and I have already contracted marriage with her younger sister, though I have not yet consummated it. Is it permissible for me to divorce the younger sister and marry the elder sister, or should I leave my brother's widow and remain married to the younger sister whose marriage contract was written previously?
Vol. 1: First: It is not permissible to marry two sisters at the same time; because of what Allah the Exalted said in explaining the prohibitions of marriage:[An-Nisa 4:23] Second: Divorcing your younger wife so that you can marry her sister, or keeping the younger wife in your possession and not marrying her sister — this depends on what you see as the stronger benefit. If you see that the benefit lies in divorcing her so that you can marry her sister to raise your nephew, or for another matter you consider better — then that is up to you. And if you see that your benefit is realized by remaining with the younger wife, then continue with her. In any case, you should consult your in-laws and seek their advice in such a matter; for fear that you divorce the younger one and they do not marry you to the elder. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
