Q3: A woman married a man, but her first husband, whom she had not consummated the marriage with after the legal contract (nikah) was completed between them three years before she married the second man, did not divorce her, although she had asked him for a divorce and insisted on it, but he refused.
A3: The second marriage is invalid; because it is a contract with a woman who is under the protection of a husband, and it is obligatory for the woman to refer to the legal judge so that her divorce or annulment from the first husband is completed, then the contract with the second husband is renewed; because the first contract is invalid, with the obligation of repentance to Allah (Glorified and Exalted is He) from both of them. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
