The fifth question of Fatwa No. ( 181 )
Q5: Is it permissible for a modest woman to remove her jilbab in the presence of her sister’s husband?
A5: Allah commanded hijab in His saying, the Exalted:[Al-Ahzab 33:59] , and He said, the Exalted: [An-Nur 24:31] , and He permitted elderly women who have no hope of marriage to remove their garments without displaying adornment, and He made it clear that not removing them is better for them, so He said, (Exalted and Majestic is He): [An-Nur 24:60] . And He specified who is permitted to look at the face in His saying, the Exalted: [An-Nur 24:31] ,
and the husband of the sister is not mentioned in this verse, so it is not permissible for him to look at her face, nor is it permissible for her to remove her jilbab in his presence; because of the temptation that lies therein, and because of what the Prophet (peace and blessings be upon him) said: , and the hamu is the husband’s brother; and that is because he enters the house without suspicion. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

O Prophet, tell your wives and your daughters and the women of the believers to bring down over themselves [part] of their outer garments
يَا أَيُّهَا النَّبِيُّ قُلْ لأَزْوَاجِكَ وَبَنَاتِكَ وَنِسَاءِ الْمُؤْمِنِينَ يُدْنِينَ عَلَيْهِنَّ مِنْ جَلابِيبِهِنَّto wrap [a portion of] their headcovers over their chests
وَلْيَضْرِبْنَ بِخُمُرِهِنَّ عَلَى جُيُوبِهِنَّAnd women of post-menstrual age who have no desire for marriage - there is no blame upon them for putting aside their outer garments [but] not displaying adornment. But to modestly refrain [from that] is better for them. And Allah is Hearing and Knowing.
وَالْقَوَاعِدُ مِنَ النِّسَاءِ اللاتِي لاَ يَرْجُونَ نِكَاحًا فَلَيْسَ عَلَيْهِنَّ جُنَاحٌ أَنْ يَضَعْنَ ثِيَابَهُنَّ غَيْرَ مُتَبَرِّجَاتٍ بِزِينَةٍ وَأَنْ يَسْتَعْفِفْنَ خَيْرٌ لَهُنَّ وَاللَّهُ سَمِيعٌ عَلِيمٌnot expose their adornment except that which [necessarily] appears thereof and to wrap [a portion of] their headcovers over their chests and not expose their adornment except to their husbands, their fathers, their husbands' fathers, their sons, their husbands' sons, their brothers, their brothers' sons, their sisters' sons, their women, that which their right hands possess, or those male attendants having no physical desire, or children who are not yet aware of the private aspects of women
وَلاَ يُبْدِينَ زِينَتَهُنَّ إِلاَّ مَا ظَهَرَ مِنْهَا وَلْيَضْرِبْنَ بِخُمُرِهِنَّ عَلَى جُيُوبِهِنَّ وَلاَ يُبْدِينَ زِينَتَهُنَّ إِلاَّ لِبُعُولَتِهِنَّ أَوْ آبَائِهِنَّ أَوْ آبَاءِ بُعُولَتِهِنَّ أَوْ أَبْنَائِهِنَّ أَوْ أَبْنَاءِ بُعُولَتِهِنَّ أَوْ إِخْوَانِهِنَّ أَوْ بَنِي إِخْوَانِهِنَّ أَوْ بَنِي أَخَوَاتِهِنَّ أَوْ نِسَائِهِنَّ أَوْ مَا مَلَكَتْ أَيْمَانُهُنَّ أَوِ التَّابِعِينَ غَيْرِ أُولِي الْإِرْبَةِ مِنَ الرِّجَالِ أَوِ الطِّفْلِ الَّذِينَ لَمْ يَظْهَرُوا عَلَى عَوْرَاتِ النِّسَاءِand the husband of the sister is not mentioned in this verse, so it is not permissible for him to look at her face, nor is it permissible for her to remove her jilbab in his presence; because of the temptation that lies therein, and because of what the Prophet (peace and blessings be upon him) said:
No man is alone with a woman except that Shaytan is the third among them. It was said: O Messenger of Allah, what about the hamu? He said: The hamu is death.
ما خلا رجل بامرأة إلا كان الشيطان ثالثهما فقيل: يا رسول الله: أرأيت الحمو؟ قال: الحمو: الموت
