A man’s marriage contract with a woman does not make her daughters mahram to him

Machine translationRead the Arabic original
Fatwa number ( 17826 )
Q: I married a woman and was alone with her, but I did not have intercourse with her because she was young, and then I divorced her. Are her daughters from the husband who came after me mahram to me? I also proposed to a woman and concluded the marriage contract, but I did not enter with her and then divorced her. Is her mother mahram to me or not? I hope for your guidance.
A: The woman with whom you concluded the marriage contract and were alone with, but did not have intercourse with, her daughters do not become mahram to you; because of what Allah the Exalted said when He mentioned the women who are prohibited:
and your step-daughters under your guardianship [born] of your wives unto whom you have gone in. But if you have not gone in unto them, there is no sin upon you.
[An-Nisa 4:23]
,
and what is meant by “entering” in the verse is intercourse—that is, sexual intercourse. If you conclude a marriage contract with a woman, her mother and her grandmothers become prohibited to you by the mere contract, even if you do not have intercourse with her—that is, even if you do not have sexual relations with her—because of what Allah the Exalted said in the aforementioned verse:
and the mothers of your wivesوَأُمَّهَاتُ نِسَائِكُمْ
, and entering was not made a condition. And Allah knows best. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
