Q: There was a dispute between him and his uncle (his wife's father) when he wanted to travel with his wife, so the uncle prevented him. He said to him: "Allow me to give you the thousand [riyals] that I owe you and your daughter; may Allah bless you in it." The uncle said: "May Allah forgive you." He asks what the ruling is regarding this?
A: If the questioner's wife's father intended by saying to him, "May Allah forgive you," to waive the thousand riyals he was demanding, based on the questioner's desire to waive them in exchange for leaving his wife, then this is khul', and his wife is divorced from him with a minor final divorce. She is not lawful for him again except with a new contract and a new mahr, with her consent and the completion of the pillars and conditions of the marriage contract, provided that this khul' is not the third divorce pronounced by him against his wife. If it is the third divorce, she is not lawful for him until she marries another husband, in a marriage of desire, not a marriage for the purpose of facilitating remarriage. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
