Q 1, 2: A man died and left behind a great deal of wealth. He has eight male heirs, one of whom has about eight sisters. He is not their full brother. They are oppressing him and telling him: "We will divide this wealth into two parts: one part we will distribute among the men only, and the smaller part we will distribute among the men and women." What is the ruling of the religion in this matter? They say: "We will agree with him on this, as I have explained to you." Is it permissible to agree to this, even though he is reluctant to do so—there is no doubt about that?
Vol. 1, 2: It is obligatory to divide the inherited wealth among the heirs of the deceased only, and this is after paying off his debt if he had one, and executing his lawful bequest if there is one. If these eight are his children and he has no other heirs, then the wealth is divided equally among them. If he has daughters and sons, then the male gets the share of two females. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
