The first and second questions of Fatwa No. ( 9305 )
Q 1, 2: I have a brother who passed away in an accident (he was crossing the street), may Allah have mercy on him and forgive him. Naturally, we received our rights from the perpetrator, which is: the blood money of one hundred
One hundred thousand Saudi riyals through the High Court, and I had a debt of seven thousand riyals owed to me by him. Is it permissible for me to take this amount from the blood money mentioned? Please issue a ruling on this. Of course, we, the heirs, consist of our mother, four brothers who have reached the age of discretion, and three daughters who have reached the age of discretion. How will the (100,000 riyals) be divided? Also, after deducting the (seven thousand riyals), how is the division done in both cases? Please issue a ruling on this.
A 1, 2: If the situation is as described, after paying off his debts if he was in debt, and executing his lawful bequest if he left one, his mother is given one-sixth, and the remainder is divided among his seven siblings, with the male receiving the share of two females. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
