Q: I am Egyptian and work in Iraq, and several months after I traveled to Iraq , I learned that my wife had passed away to the mercy of Allah while I was away from the country for a period of eight months. Before I traveled abroad, I took her jewelry, which was gold and silver, before the trip. She left me three daughters in the house: the eldest is seven years old, the second is five years old, and the third is three years old. I have an elderly mother who cares for them in the house. Does she have no right to her jewelry after her death, or do her minor daughters have a right to it? Please give us a ruling.
A: If the situation is as you described, her jewelry is added to the wealth she owned at the time of her death, and all of it becomes an estate to be inherited from her. After paying off her debts, if she was in debt, and carrying out her lawful bequest, if she made one,
her estate is distributed among her heirs according to the Islamic law of inheritance. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
