Transferring wealth to deprive some of the heirs
Machine translationRead the Arabic original
Fatwa number ( 16666 )
Q: My Lord has provided me, and all praise is due to Allah, with four daughters (aged 10, 8, 5, and 3) and a wife. I have a married sister who has children, and I own a building consisting of four apartments. I wrote a sales contract between myself and my wife for one-third of the building, and I wrote another sales contract between myself and my wife for a portion
for the purchase of the second third for the daughters. The first third is for the wife, the second third is for the daughters, and I left the third third. And of course, I will be honest with you that I did not receive any amount of money. The purpose of this is so that no one disputes with them regarding the inheritance, because they are daughters (i.e., weak offspring). What is the ruling on this? Please inform us, may Allah reward you with good.
A: It is not permissible for a person to take the measure of a transfer contract for his wealth in order to deprive some of the heirs. And Allah, Glorified and Exalted is He, is aware of every servant and his intention and purpose. We warn you not to follow a path for which you will be tormented. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
