The fifth question of Fatwa number ( 5741 )
Q5: The groom stays with his virgin wife for a week, and with his previously married wife for three days, and does not go out for the congregational prayer. Is this in accordance with the Sunnah, even to the extent of not going out for the prayer?
A5: If he marries a virgin, he stays with her for seven days and then divides the time. If she is
previously married, he stays with her for three days. If she wishes him to stay with her for seven days, he does so and makes up the days for the others. The basis for this is what Abu Qilabah narrated from Anas (may Allah be pleased with him), who said:
It pertains to the sunna that when a man who has a wife marries a virgin he should stay with her for seven nights and then divide the time between them, but if he marries a woman who has been previously married he should stay with her three nights and then divide his time between his wives. Abu (Qilaba remarked that if he wished he could say that Anas traced it to the Prophet.من السنة إذا تزوج الرجل البكر على الثيب أقام عندها سبعا وقسم، وإذا تزوج الثيب أقام عندها ثلاثا ثم قسم، قال أبو قلابة: لو شئت لقلت: إن أنسا رفعه إلى النبي -صلى الله عليه وسلم-

. It is agreed upon by al-Bukhari and Muslim, and the wording is al-Bukhari's. And what Umm Salimah (may Allah be pleased with her) narrated,
That the Prophet (peace and blessings be upon him), when he married her, stayed with her for three days and said: It is not that you are of little value to your family. If you wish, seven days are for you, and if you give me seven days, I will give seven days to my other wivesأن النبي -صلى الله عليه وسلم- لما تزوجها أقام عندها ثلاثا وقال: إنه ليس بك هوان على أهلك، فإن شئت سبعة لك وإن سبعت لك سبعت لنسائي
narrated by Muslim . It is not permissible for a man who has married a virgin or a previously married woman to delay the congregational prayer in the mosque on the pretext that he is married; because there is no evidence for that, and the two hadiths mentioned do not imply that. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
